1. ROTADAIRON offers its customers a one-year commercial warranty covering the replacement of defective parts excluding transportation and labour from the date of issue of the equipment invoice to its distributor.
In addition to this guarantee, ROTADAIRON offers its customers the subscription of a payable contractual warranty for an additional year intended to cover the replacement of defective parts excluding transport and labour of its equipment in case of defect, anomaly or deterioration of the latter under the conditions set out below.
This additional guarantee will apply once the one-year commercial guarantee has expired and is included in the sale price of the equipment. If the Customer does not subscribe this option, he is informed that all the fees relating to these interventions on the hardware will be the responsibility of the Customer.
This warranty applies to any material or construction defect not apparent at the time of the delivery of the machines, inherent to the machine delivered and prior to sale. Wear parts as specified in the user manual and consumables are excluded from this warranty.
Damages and/or costs incurred are expressly excluded from this warranty:
- Normal wear and tear of machinery and parts ;
- By damage due to customer negligence, or failure to comply with the recommendations for storage, assembly, maintenance or use of the machines according to the machine manuals, instructions for assembly or instruction and/or other recommendations transmitted (in particular the manufacturer’s maintenance requirements);
- Use not in accordance with machine manual instructions, good practice in the profession or not appropriate;
- By using inappropriate materials (fuels, lubricants, etc.) or materials that do not comply with the manufacturer’s recommendations;
- By any modification of the machine or parts by customer or third party, without prior written permission of our company;
- By the use and/or assembly of parts other than those of origin or not supplied by our company ;
- By components which have clearly been disassembled and in particular those whose rupture of a disassembly witness attests without the prior authorization of our company ;
- Resulting from accident, malice, war actions, attacks;
- By weather events, natural disasters or as a result of chemical, electrochemical, electrical or similar reactions.
In any event, our company recalls that it cannot be responsible for any breaches of the customer’s obligations vis-à-vis its own customers and that this guarantee cannot be involved in such a case. Finally, this warranty is expressly excluded in the event that the defect(s) or anomaly(ies) is(are) of the case(s) of force majeure as stipulated in article 9.4 of these general conditions.
2. This guarantee is subscribed for a period of one year applicable to the day following the expiry of the one-year commercial guarantee.
3. This guarantee is subscribed for a fixed amount corresponding to 3.5% excl. tax of the material price. This package is payable on the day of purchase of the equipment, according to invoice.
4. To implement this guarantee :
4.1/ The Distributor, on behalf of the Customer, completes the form provided on the dedicated space on the ROTADAIRON website under the conditions provided for in the General Terms and Conditions of Sale as regards apparent defect(s) and non-conformity(ies), and as soon as possible after the discovery of the defect(s) concerning hidden vice(s).
4.2/ On this occasion, he will inform ROTADAIRON, in writing, that he wishes a replacement or a refund of defective part in case of spare part in stock by ROTADAIRON under this warranty.
4.3/ Once the non-conformity, defect or anomaly has been detected by ROTADAIRON and the defective quantities are replaced by similar parts; ROTADAIRON will confirm its intervention under this warranty in writing to the Customer.
5. This guarantee is subject to the ROTADAIRON General Terms and Conditions of Sale appended hereto and the Customer declares that it recognizes and accepts the stipulations.
